    If other party is suing in small claims you need to have your own insurance company represent you and if they don’t they will be acting in bad faith. With respect to the other insurance company their opinion has no baring what so ever; it is useless and self-serving.

    You definitely have a case against the assaulting individual, problem is the big drunk probably doesn’t have any money and would just be a waste of your time.

    I can never understand why insurers don’t release their insurance limits when requested by claimant’s Attorney. In 32 years I’ve never seen the down side in an insured releasing limits, if anything else it will help expedite resolution of claim and avoid your daughter from being sued.

    Unfortunately you have gotten thrown in the middle of this situation. Dog owner is always at fault and responsible. Unless the incident occurred on your property I don’t see any liability at this juncture. However to be safe put in a claim into your homeowner insurance.

    Insurance companies are funny and adjusters sometimes think they are liability experts; their determination will have no bearing on your driving record. You’re in good shape.

    Hello, this response is strictly based on past experience but some things that could happen are, 1. Judge will see you have tried multiple times to serve the restraining order and grant it on the spot or 2. Judge may continue the case and give you more time to try to serve him.
