  • 2 car accidents in the same not my fault hows work?

I involved in two car accidents separate cases but the same month first one state farm's client and second mercury's client. My question both companies will pay separate 2 checks or the second company will know then i will get only one check. ...

Sorry to hear that. It is a little more complicated. The second insurance company (Mercury) will blame your injuries on the first accident and the first company (State Farm) will blame your injuries on the second accident. If you injured different body parts, then you might be able to separate the two cases. You will get two checks, but the amounts will depend on how well your injuries and treatment is documented. I would consult with an attorney.

  • Are "Settlement Out of Court" proposals effective for Malicious Prosecution and Abuse of Process situations?

I know it depends of the party receiving such a letter and how they will react, but hoping to avoid the time, costs and drama of going to court at the same time standing up for my civil rights. Thanks

    Maryam’s Answer

It is my understanding that you must win in court and receive a judgment in your favor in order to have a Malicious Prosecution Claim.
