  • Excess damage claimed by 3rd party insurance company. I have photos of accident vehicles to prove it. What should I do?

Last week of August, I met with an accident while driving a rented car. It was my fault. While renting the car I purchased full insurance coverage for damage and liability. The other insurance company claims damages of $7000. In the itemized bill ...

    Maryam’s Answer

I agree with Mr. Gross. Your own insurance policy for your regular vehicle would possibly cover you, depending on the reason for the need for the rental car. For example, if your regular car was in the shop from an unrelated accident. You could contact your insurance company and investigate. In doing so, provide them with those pictures and any/and all other information you have. If you are unsuccessful, you can always contact an attorney using the Avvo attorney finder for help.

  • Do I have a Product Liability/Personal Injury case against a major market and its supplier?

Bought a package of hamburger meat from a well established market. Made a hamburger. Bit into the hamburger and injured a bottom molar which eventually broke. Contacted the market the next day and within two days was contacted by the supplier. He ...

    Maryam’s Answer

I would have to agree with my colleagues. I do not see that you have updated your post or any of the comments with what exactly caused the hamburger to break your tooth. If it was in fact a foreign object, then you may have a case. However as previously suggested, given your stated damages, your best route is to handle the claim in settlement with the supplier (and/or the market) or in small claims court. Best of luck.

    Maryam’s Answer

I would recommend contacting an attorney in your area as the injury involved sounds very serious. A skilled personal injury attorney will investigate the circumstances surrounding this accident to determine if in fact this particular table and bed scenario would fall into the category of a dangerous defect. Also, they should be able to assist the individual who was harmed in getting the best possible medical treatment. Please be advised there is a time limit in which a claim would need to be filed. An attorney you trust can assist you.

  • My car was parked on the street and someone with a uhaul hit the car and did $3000 worth of damage. They were not insured.

I filed a claim with Uhaul and they said they would cover it up to $5000. The shop gave them a quote and they came back with aftermarket parts. The shop told me that the parts were not very good and that they may not fit properly. I called the in...

    Maryam’s Answer

Under California law the registered owner of the vehicle is only liable to pay $5,000 for parts and repairs. Send them three different appraisals and they will average the three and should send you a check. If you do not receive the check promptly, file small claims. Good luck.

  • Not at fault injury over policy limit in CA

I was in an accident in CA. An East bound car made a left turn at intersection while I was traveling West bound. The light is green for me. In trying to avoid hitting the car, I swirled and hit a pedestrian causing a compound leg fracture. The tur...

    Maryam’s Answer

Your insurance company should handle this for you. It's highly likely that the injured party will accept the $250,000.00 policy limit as it is extremely difficult to proceed with a lawsuit to go after assets and property, especially if you do not have property or assets. Your insurance company should offer Policy Limit and make sure they obtain a signed release of all claims. It seems as though you were not working at the time of the accident. However, do you usually drive your car for work purposes? More information is needed to properly answer this question.

  • Accept Personal Injury Settlement?

A relative of mine was injured by a driver, and has been offered a settlement of $280K. They are represented by an attorney who will be getting 30% of that. I know this is a very broad, general question, but is it typically better to accept settle...

    Maryam’s Answer

It is extremely difficult to value a personal injury case without reviewing medical records and billing. Every case is unique and people heal differently. An injury case is valued based on the total amount of medical bills, general damages for pain and suffering, wage loss, and future medical treatment. Your relative has an attorney and it's highly likely that the attorney has reviewed all of the facts and circumstances of the case before recommending the settlement. They should contact their attorney with specific questions and how/why they came to that value. Good luck!

  • Injury - insurance

What means securing medical records pertaining to your treatment and why an insurance company (Residential public space slip and fall) wants to do this.

    Maryam’s Answer

The insurance company wants to obtain your medical records and billing to evaluate your injury case. It is in your best interest to contact a personal injury attorney for a free consultation. The insurance company does not have your best interest in mind. They will likely delay your claim or under-value it. Be smart and retain an attorney!
