  • Can you get arrested for conspiracy to distribute a controlled substance in California and be found not guilty without a lawyer?

Son was at a concert. He was approached by an unknown dealer and asked him if he wanted drugs. He said no. He was later approached by undercover police and asked if he had any drugs, He said no but told her where she could get some and walked her ...

    Robert’s Answer

Without an attorney he will have a very difficult time. Attorneys are professionals. It surprises me how often people that have no training or experience in law assume they can do just as good as a job as someone that does it for a living. If you have a plumbing issue you call a plumber. If you are sick or injured you see a doctor. However if you are arrested people feel they can just handle it on their own. The prosecutor is a trained attorney that does this for a living. If you are comfortable not calling a plumber or a doctor then don’t hire an attorney.

  • Can a judge in Nevada prevent you from taking prescribed medication from an MD?

    Robert’s Answer

Yes, you agreed to enter the program to avoid jail time. It is not right that they will not allow you do take what your doctor is prescribing but that is not unusual. Prior to any of my clients entering into such a program these are things I get set in stone prior to entering the agreement.

  • What is the attorney fee for representing a minor in possession charge (18 year old) in court? Infraction, not misdemeanor.

No prior legal history. Can't appear because she's in college, 300 miles away. She was downtown with a group of friends (college town), and she was caught with an open container of alcohol, underage.

    Robert’s Answer

Each attorney is going to charge different amounts. Even though it is an infraction and not a misdemeanor any good attorney will still be doing the same amount of work so you will not see a large price difference. The major issue is if she is found guilty she would lose her license for a year. It may cost upfront but how much is a license worth for a year.
