In October of 2009 I entered a plea of no contest. At that time, the California Dept of Corrections set my release date to be in the year 2015. Unbeknownst to me, this release date was incorrect. In fact, had the CDC correctly calculated my rele...

    Robert’s Answer

Yes you can apply for early termination of probation and then typically your attorney will also seek an expungement as well. I believe this is what you are looking for. My office handles these all the time. You call my office or look up another attorney here on AVVO.

You may want to double check with an employment attorney however I do not believe that these hearings are confidential so I would be careful about saying anything that can be used against you in criminal court.

  • What will more likely get a case into federal criminal court? 50g of cocaine or 25g of MDMA and 25g of methamphetamine?

From your experience, what will more likely get a case into federal criminal court? 50g of cocaine or 25g of MDMA coupled with 25g of methamphetamine

    Robert’s Answer

First you do not want a case in federal court. Second I can think of no lawful reason that you would need an answer to this. All are bad choices stay away from drugs.

  • Is it legal to HOLD your cell while talking using the loud speaker option (in CA)?

I got pulled over and cited for a cell phone ticket while driving. The officer said he saw me motioning my hand around as if i was talking. Although I was holding my cell phone in one hand, I was using the loud speaker. Is this illegal in CA?

    Robert’s Answer

If you are using your hand to talk on the cell phone you are not hands free. I feel you know that answer but want an attorney to say this is legal. Well it is not and the judge will not buy it.

  • I need a lawyer for a criminal case, we can't afford one at this time. Need help. Can you help with criminal cases?

Can not post reason need it to be private.

    Robert’s Answer

Please understand private attorneys run businesses. The way they make money is through paying clients. So unless you are a public defender or are somehow on a conflict list that and the government pays you to represent a criminal defendant, private attorneys do not take cases on for free. There are attorneys that already do that; public defenders.

    Robert’s Answer

You have a lot of misinformation. It appears that you are on either OR release or out on bail either way unless something changes you will not be placed in custody at the next court appearance. Additionally, the substance would have to be tested by a lab or at least using a simple kit the officer has.

  • How do I get records that were 20 years ago

    Robert’s Answer

The records if they still exist would be stored by the court. You would need to go to the courthouse and request them. You will also have to pay for them.
