    No attorney will take your case post filing, period. Sorry to say that but it is the truth. There are several reasons for this. The main ones are the attorney will have to most likely redo all the paperwork and there will be a significant issue of that attorney getting paid. If you do this alone you will remain alone.     Miranda no as that only applies to custodial interrogation and roadside DUI questions are exempt from Miranda. The 15 minute period may be grounds for some of the evidence to be suppressed which can potentially lead to the case being dismissed. Robert Driessen

    The police can arrest you for this charge. What you need to do is hire an attorney to defend you. These cases are very hard for the prosecution to prove. Robert Driessen

    Most courts will not allow a special appearance unless there is already an attorney of record on the matter. Some courts may allow a special appearance if the attorney is still working out a fee and does not want to be attorney of record yet. However in this case the answer is no. Robert Driessen

    Yes courts have deemed this is sufficient. However, it will still be worth hiring an attorney to see if there is a 1538 and potentially use it to get the DA to lower the charges to something less than a DUI. Robert Driessen

    You will want to sit down with a local criminal attorney. There are some ways to avoid 290 but your attorney will need a lot more information and it is not an easy process. Robert Driessen

    No one passes standard field sobriety tests. Not even an Olympic gymnast can pass. They are designed for you to fail. Never take them. Ask the police officer nicely if they are required (they are not) and decline to take them. Your best chance at this point is to hire an attorney. Robert Driessen

    Make sure you contact the DMV within 10 days of the arrest to schedule a hearing. Failure to do so will result in an automatic suspension. Fighting the DMV with a .14 is tough but not impossible. You need an attorney with both the DMV action and the court case. Robert Driessen
