  • I was in the car with someone that got arested for dUI and the officer arrested me for drunk in pulick but i was not in public

    The officer arrested me for drunk in publick but i was in the car getting a ride home and did not know that the person that was driving had to many too drink and that person got arrested for DUI. Can i fight this charge?

    The police can arrest you for this charge. What you need to do is hire an attorney to defend you. These cases are very hard for the prosecution to prove.

    If the car was registered in another state and was not required to be registered in California the law of the state where the car is registered would be the one that would be followed. This happens very often with no front license plate stops involving out of state vehicles. I do not know the law in Idaho but if the hitch is legal there the police in California cannot cite you for it. The issue that you may run into when your attorney files the 1538.5 is that did the officer act in good faith and believe that he was pulling you over legally.

    If your case is in Orange County after the judge reinstated you into the program you would have been ordered to appear at the alcohol liaison. They are located within each of the Orange County courthouses.

    The real question is can the DA prove the case against you for your new charge. A lot will depend upon the facts of your case. You need an attorney. If the police are pulling you over whether you believe it to be legal or not it is best to pull over or else things just get worse.

    This is very simple you need to pay them all off. The older they get the more expensive they get and they will take on things like civil assessments that make you have to pay even more. Stop getting tickets, clearly you are either unlucky or a bad driver and pay them off.

    You have multiple records Once record is your criminal record, what you got expunged. Understand it does not seal your record. An expungement does not affect anything on your DMV record that is 100% separate and will stay for 10 years no matter what you do.

    If you are a commercial driver and you get a DUI you need an attorney for both the DMV as well as the criminal court aspect. I am sure you heard the term penny cheap pound stupid. That is what happens when you try to handle your DUI without an attorney. The fact that you have a commercial driver’s license just multiples the effect. At this point there is really not much an attorney can do. You will just have to wait until it comes off your DMV record.

    If you do this make it 100% clear to all guests that alcohol is not allowed and if you see it instantly throw them out. It is always more fun to be at a party and not be the host.
