    Robert’s Answer

The discovery process in criminal courts is quite easy. The defense attorney goes to the prosecutor and asks give me what you have and the prosecutor must turn over all the information. This includes all potential witnesses. Prior to a trial the defense attorney will talk to potential witnesses. It is quite hard for someone to impersonate a witness. Most criminal cases that go to a jury trial take almost a year. This would mean this person would have to assume the witness identity for a year. It would make a great movie plot or TV show but in reality it is a non-issue.
