These are all matters you should be discussing with your attorney; now the public defender. Whenever you hire an attorney you should get a written fee agreement that details what the fee is for and if it includes a trial. Most attorneys will charge extra for a trial and should make it clear in the written fee agreement. The good news is the marijuana cases are difficult for a prosecutor to prove but you will need a skilled attorney in the courtroom defending you. Robert Driessen

Yes it is possible to have a no bail hold due to a probation violation. I am not certain why you have not had a hearing yet. Since you are in custody you should seek the services of the p ublic defender.

Yes your case is on calendar. There are a couple direct files in Orange County that do not go through the DA’s office but for the most part this means the DA reviewed your case and charges were filed. Robert Driessen

Please understand why the one attorney mentioned the 60 days. Based on the facts that you provided you are looking at not only the DUI but two enhancements to the DUI the first being the BAC at or above a .20 the second one is the speed enhancement since you were in excess of 35 mph. The speed enhancement alone is 60 days mandatory minimum jail time. You need to hire an attorney that can work on getting the prosecutor to get rid of the speed enhancement. Robert Driessen

Your attorney will be able to explain this to you. Federal drug cases are no joke. Understand almost anytime you are doing illegal activities with someone you can be charged with conspiracy. It does not matter if they only file charges against you and not the coconspirator. Robert Driessen
