    Plaintiff Paseo Vista Homeowners Association, a 65 single-family home development, filed suit against the Defendants after a series of heavy rainstorms caused severe flooding in 2008, 2009 and 2010 throughout the streets, yards and common areas of the Paseo Vista project. The Developer Defendant Paseo Village Development, LLC settled for $599,000 on the first day of trial. Defendant Stantec, the project civil engineer, rejected Plaintiff's final settlement offer of $599,000 and countered with a $15,000 "take it or leave it" settlement offer to Plaintiff Paseo Vista HOA. Plaintiff rejected the offer and proceeded to trial against Defendant Stantec.
