  • John Noah Kitta

I endorse this lawyer. I entirely agree with Shaun K. Boss in regard to his analysis of your situation, too little facts to give a definitive answer. On the other hand I suppose you want some sort of answer and I will do the best I can do to read between the lines and give you my best projection. Unless your parents had an extremely huge mortgage payment, if you moved in fifteen years ago and paying the payments, probably not. It sounds as if that your funds may have been joint coming out of a joint account may have had the rental property for far less than for fair rental value. With a lot of additional facts there is a lot that needs to be done but I think by in large there is a significant probability that if you obtain ownership of the house by and through your name on title or through being the alternative beneficiary of their trust, that at that point and time your husband may not have any interest in the property.
