    We were both turning right, he got in my lane and hit me, police report wasn't very helpful. Officer was unable to find who was at fault. My insurance company totaled car and I am yet to hear from other party. This was 2 months ago

    I believe it would be best to contact an attorney for a free consultation and provide the attorney with a copy of the police report for review. There are many instances where the police report is inaccurate and facts/evidence within the police report will be used by your attorney to build your case.

I would recommend that you avoid giving a statement to the insurance carriers and allow your attorney to handle the statements. Your attorney should also help you handle the property damages claim.     In California, if you were the not at fault driver, you may recover economic damages (e.g., medical bills, loss of earnings, property damages, etc.) but unfortunately you can't recover non economic damages., e.g., pain and suffering (Propesition 213). However, your son may be entitles to both economic and non economic damages if he was the passenger). I recommend that you contact a personal injury attorney as soon as possible.
