    There are some other facts needed to be known. However, if you are cited to go downtown there is a lot you can do to give yourself the best chance for resolution. One of these would be to obtain a local attorney. They can even go to court for you, saving you time away from school. Call some lawyers here on Avvo and see if they are a fit for you.

    You should always consult with an attorney before you make a decision. With a .08 bac you may have possible defenses that an attorney can explore. No APS means the attorneys may charge a bit less. Check the folks out here on Avvo.

    With a violation, it becomes discretionary. For the best chance of success when you have a prior violation (and some other issues), get a lawyer.

    You've got a warrant and a probation violation. If you are taken into custody a public defender can handle the matter for you.
    If you live in New York and want the matter handled without you here you should retain an attorney.
