  • I got a Dui 3 years ago in CA but never went to the classes or paid the fine, how do I take care of this now?

I don't have any record other than my 1 DUI. I obtained my DUI in California 3 years ago but now live in New York. I want to take care of this but don't know where to begin. I had a monthly payment system set up but only paid the first few months...

    Mark’s Answer

You've got a warrant and a probation violation. If you are taken into custody a public defender can handle the matter for you.
If you live in New York and want the matter handled without you here you should retain an attorney.

  • What income factors play into whether I qualify for a public defender?

I got a DUI and blew a .13 at the jail. This is my first offense, no injuries or damages happened. I was on a small motorcycle and went wrong way down one way. One lawyer told me it is unlikely I'll get a wet and reckless and that I should use a p...

    Mark’s Answer

The Public Defender is there for indigent people. When you head to court you will have to fill out a financial declaration form to determine if you qualify.
I would consult with other attorneys on Avvo because a wet may be a tall order but never out of the question. The attorney has to review the evidence. The attorney can also go to court and advocate on your behalf at a APS hearing. There is other options than a "wet" or a "DUI" as well. A DUI case is comprehensive and I would find out as much information as you can to make a sound decision.

Can anyone recommend an attorney for a sentence modification. I've had my SCRAM on for almost a year and would like to see a judge about getting it removed. I refuse to use my original attorney.

You should research a few attorneys here on Avvo. I would call them to discuss their rates. There are several attorneys who would likely represent you in this limited scope.

    Mark’s Answer

Your boyfriend needs to consult an attorney. There is some hypothetical scenarios where he can be charged with your scenario. There seems to be more facts that need to be flushed out. Speak to an attorney so he will be able to get an idea of the prosecutions theory.

The key is to be proactive and let your attorney obtain the facts of the case ASAP. Do not wait for the court date.
