    Yes, even if you did not have the prior grand theft you would be looking at significant time for the residential burglary with the hot prowl allegation. If you plead guilty or are convicted it is a mandatory prison term of 2 years, 4 years or 6 years at 85% time. The prosecutor and judge will also see you have a prior theft offense and that will certainly not help your cause.     Its possible but will depend on many factors including what courthouse the case is in and the prosecutor who the case is negotiated and your attoney's relationship with that prosecutor. If this case is in north county Vista courthouse I have had cases with higher BAC levels negotiated down to a wet reckless. However, it is not easy on a 0.13 in Vista and only certain prosecutors are willing to do it, but it certainly is possible especially since it doesn't sound like they have any FST's to use...

    It's a possibility due to Vehicle Code section 23572 which is an enhancement for a DUI which triggers mandatory additional jail time of at least 48 hours when a minor under 14 is in the vehicle.
