Ms. Palecek concentrates her practice on representing small business owners, information technology firms, real estate professionals and individuals with their estate planning and family law needs. She currently manages PMA LAW’s family law and estate planning practice.
In doing so, Ms. Palecek has drafted comprehensive estate plans utilizing complex trust planning provisions such as revocable living trusts, marital deduction trusts, bypass trusts, life insurance trust, charitable remainder trusts and mixed pot family trusts. She has also counseled clients on sensitive family law issues relating to guardianship and conservatorships and is skilled in drafting durable financial and medical powers of attorneys, advance health care directives and all types of wills.
Ms. Palecek is also highly experienced in the transactional areas of real estate, land use and construction law. Prior to entering the legal field Ms. Palecek owned and operated a real estate sales, development and mortgage company in San Diego for six years. Ms. Palecek has over ten years of experience in the real estate industry which is an invaluable asset to her business clients.
As a small business owner and manager, Ms. Palecek knows firsthand the legal questions and issues small businesses face. During the course of her real estate career Ms. Palecek negotiated broker relations with over 20 major lending institutions and brokered over 25 million dollars in residential and commercial loans and as well as purchase contracts. Ms. Palecek also assisted in the design build of a 38-unit PUD project in which she dealt with the real estate acquisition for the project, land use regulations and construction issues. She has experience dealing with construction teams, architects, zoning authorities in all aspects of the design build process.
In pursuit of better representing small business, Ms. Palecek has attended several continuing education conferences in the areas of business planning, wine law and securities regulation. She has written two scholarly reviews in the area of business law. The first review is in the area of wine law titled; “Intellectual Property Issues in the Wine Industry: The lack of a private cause of action under current international agreements creates ineffective means of relief for intellectual property infringement.” The second is a review of the interplay of real property law, revenue code and securities regulation titled; “Tenant In Common Interests: The Inadequacies of Securities Regulation and Revenue Code to Protect Investors.”
Ms. Palecek serves on the board of Love Road, Inc. a 501(c)(3) non-profit corporation dedicated to providing a home for America’s wile horses and burros. Love Road Sanctuary is committed to helping the thousands of wild horses that have already been gathered by the Bureau of Land Management and are currently living in holding pens all across the United States. These horses can never be returned to the wild. Ms. Palecek assists Love Road in its mission is to provide these animals a permanent home. Ms. Palecek serves as Love Road’s legal advisor, ensuring that it maintains its tax exempt status. She also handles all media relations and negotiations for the organization.
Ms. Palecek received her Juris Doctor degree from California Western School of Law and Bachelors degree from University of California at San Diego in Human Development. While at CWSL, she earned the American Jurisprudence Award (highest grade in class) in Business Planning and was a member of the Dean’s List and graduated in the top third of her class.
