    Fernando’s Answer

The absence of a seatbelt deprives the claimant from receiving compensation for injuries, which the seatbelt would have prevented such as impacts with the windshield or being ejected from a vehicle. The absence of a seatbelt deprives the claimant from receiving compensation for injuries, which the seatbelt would have prevented such as impacts with the windshield or being ejected from the vehicle. The seatbelt cannot prevent soft tissue injuries, i.e., muscular strains and sprains. Therefore, if you suffered soft tissue injuries, you are entitled to compensation for your medical expenses, your lost earnings from work, any other out-of-pocket expenses, and of course, for the pain and suffering related to your injuries. Best of luck!

  • I rear ended an a motorist with a suspended license driving someone elses car after they slammed their breaks in the fast lane.

No police report was taken but an officer did give her a citation for having a suspended license. Is there anything that would protect me from being listed as "at fault" from her status?

    Fernando’s Answer

Unfortunately there is nothing, based upon the information provided that would prevent you from being found liable for having caused the accident. The absence of a valid driver's license is not, in and of itself, dispositive on the issue of liability. If the other motorist slammed on the brakes to the vehicle for a valid reason such as to avoid a pedestrian, vehicle, animal, or object in the roadway, you would be found at fault. More information is needed to assess the reasons, which caused the other driver to slam on their brakes. Best of luck!
