Bicyclist vs. Defendant Driver

Case Conclusion Date: 06.01.2012

Practice Area: Personal Injury

Outcome: Settled at mediation for $125,000

Description: Our client was riding his bicycle at night across a highway when he was struck by a negligent driver and seriously injured. Our client was under the influence of alcohol, and he did not have a light on his bicycle. The intersection was illuminated by two streetlights. We chose to represent this accident-victim because the defendant driver was driving irresponsibly. Prior to being struck, our client had crossed 90% of the highway and the defendant driver had ample time to see him on his bicycle. In fact, the defendant driver's own passenger saw our client before the impact--so did the driver of an adjacent car and a car that was trailing the defendant's car. The defendant driver was simply not keeping a proper look-out.
