So you want someone to take on Wells Fargo and its big box lawyers, on a contingency, and no doubt pay all the expenses for 1/3 of $70,000 in lost equity if that number is correct and a jury gives you everything you ask for on that. And, who is advancing the daily jury fees of $300 per day? As far as emotional distress- you sound cool and collected to me. On the other hand, if we lose, your lawyer gets nothing, and is out costs? Typically lawyers handle personal injury cases on a...

NO. I am just a sole practitioner and I have sued larger companies than Disney on much bigger and more complex cases than a personal injury matter. It does not matter that the Defendant is Disney. This is not a difficult case to prepare and try, most likely. I worry about the validity of the case itself. Are you saying that Disney incited a riot at its own theme park? If the argument is that Disney is liable due to something that went out over the airwaves of one of its stations--not a...

The California State Bar requires fee agreements between an attorney and an individual client to be in writing when the fee is expected to exceed $1000. Since the retainer is $2000 in the case of your sister, this rule would likely apply. In that written fee agreement there will be a section that will precisely explain the terms and conditions of the retainer as well as all other fees and costs that must be paid. As all the other attorneys have pointed out, the term retainer is ambiguous;...

False. The second amendment was enacted so that citizens could keep arms and be formed quickly into militias to fight indians and possibly the British- not their own government. In fact in the Revolutionary War 50% of our force was militia and 50% the Continental Army. Washington hated fighting with the militia due to their lack of training and poor discipline. Some morons have managed to hijack that history and now claim that the purpose of the second amendment is to protect citizens from...

No, Hyperventilation is not worth suing for, not to mention that you brought on your distress by your own criminal act. Get a criminal defense lawyer and good luck with that.

If the demurrer was granted with leave to amend you should amend. If no leave was granted, you wait for a judgment of dismissal to enter then appeal to the Court of Appeal- of course this is not something you can ever handle yourself- it is too specialized, difficult and arcane.
