    Have you filled out the agency's government claim form? If the bus belongs to a government entity, you have 6 months to file a claim with them as a first step and if you haven't done so already, you should do so immediately. Did they deny the claim, if you have already filed one? Did you sign a Release in exchange for the $6,000? If MediCal or Medicare or other insurance has paid for your medical treatment, they may seek some reimbursement.

    How many attorneys have you consulted with? Have you provided any/all of them with your aunt's complete medical records? Generally speaking, medical malpractice cases require a lot of upfront costs and expenses in order to litigate so attorneys maybe be more selective as to which to take on. You may want to consult with attorneys outside of Sioux Falls within South Dakota to see if they would be willing to take on the case.

    Depending on a number of factors, it is possible that you can be sued and have your assets in Canada sought to pay the judgement, but a lot more would have to be known to give you a better answer . You may also want to try purchasing an umbrella policy from a different company and also see if whatever insurance you have covering you in Canada would extend and apply to a potential judgement against you in the US.

    Depends what you are ultimately seeking. If you are seeking to go after the hospital in a medical malpractice lawsuit, you should contact a local attorney that handles medical malpractice cases immediately. The statutes of limitations for medical malpractice, especially if it is a public hospital is something to consult with an attorney ASAP.

    Generally speaking, the driver who rear-ends someone is found at fault, but not "automatically". The relevant CA Vehicle Code Section is 22350. Here is a sample of the Code and jury instructions provided by Justia:

    Basic Speed Law (Veh. Code, § 22350)
    A person must drive at a reasonable speed. Whether a particular speed is reasonable depends on the circumstances such as traffic, weather, visibility, and road conditions. Drivers must not drive so fast that they create a danger to people or property.

    If [name of plaintiff/defendant] has proved that [name of defendant/plaintiff] was not driving at a reasonable speed at the time of the accident, then [name of defendant/plaintiff] was negligent.

    More information would be needed in order to give you a more proper answer. However, was your car insured at the time? If yes, you should forward the papers to whatever insurance company you had at the time. Otherwise you should look at hiring a defense attorney, sounds like the other person may have gotten a default judgment against you. You should consult with a local attorney ASAP.
