Depends what you are ultimately seeking. If you are seeking to go after the hospital in a medical malpractice lawsuit, you should contact a local attorney that handles medical malpractice cases immediately. The statutes of limitations for medical malpractice, especially if it is a public hospital is something to consult with an attorney ASAP.

  • Does hitting someone from behind in CA automatically make you negligent?

Bumper to bumper traffic, other driver stopped short and was hit from behind. Is the driver who was not hit from behind automatically negligent, or is the rule that the person who hits from behind is at fault just the policy of insurance compa...

    Daniel’s Answer

Generally speaking, the driver who rear-ends someone is found at fault, but not "automatically". The relevant CA Vehicle Code Section is 22350. Here is a sample of the Code and jury instructions provided by Justia:

Basic Speed Law (Veh. Code, § 22350)
A person must drive at a reasonable speed. Whether a particular speed is reasonable depends on the circumstances such as traffic, weather, visibility, and road conditions. Drivers must not drive so fast that they create a danger to people or property.

If [name of plaintiff/defendant] has proved that [name of defendant/plaintiff] was not driving at a reasonable speed at the time of the accident, then [name of defendant/plaintiff] was negligent.

More information would be needed in order to give you a more proper answer. However, was your car insured at the time? If yes, you should forward the papers to whatever insurance company you had at the time. Otherwise you should look at hiring a defense attorney, sounds like the other person may have gotten a default judgment against you. You should consult with a local attorney ASAP.

    Daniel’s Answer

Your health is most important. Have you sought a second opinion from another doctor? Have you done a pro/con analysis on the advantages and disadvantages of surgery with your doctor? Do you have health insurance? These are important questions you should discuss with your health care professionals and attorney. Each case has a different set of facts and circumstances both medically and legally, as such, there is no set answer to what your settlement should be, especially without additional information.
