  • After a police report has been made against me. what is the "Time Frame" I should expect until police start questioning me.

if I don't answer any questions can they still arrest me? or not until the DA presses charges?

    Elliot’s Answer

They can arrest you at anytime, even if you don't answer a questions, so long as they have an arrest warrant or probable cause to arrest where a warrant is not required. They can even take you in for questioning and keep you for 72 hours without formally arresting you. So, with that said, right now is the BEST time to hire an attorney to represent your rights.

  • How much does it cost to hire a lawyer to motion to terminate early probation and file an expungement or petition for dismissal?

How much does it cost to hire a lawyer to motion to terminate early probation and file an expungement or petition for dismissal?

    Elliot’s Answer

Every attorney charges a different amount. You should call a few attorneys and not just ask how much, but ask if its a good idea to do it. You are going to need to show good cause to terminate early and you are going to have to make sure all terms of your probation have been completed before the judge would even consider doing this.

  • Will DUI violate the terms of my PC 1000?

I was arrested for possession of cocaine in Los Angeles County and given PC 1000 deferred entry of judgement last January. I completed the classes but on the 4th of July I was arrested for DUI 2 blocks away from my home in Orange County. My next c...

    Elliot’s Answer

It will definitely violate the terms of your PC1000, but you may still have other relief available to you! So, don't hit the panic button just yet. You may still qualify for Prop 36 or get back into PC1000. As far as your DUI is concerned, you are going to need to fight that and you should have the same attorney who is fighting your DUI also take care of your possession case.

  • How do I choose a competent criminal defense attorney?

A friend of mine has a criminal background that consist of many theft-related charges. He is now fighting a 2nd degree Robbery (A Petty Theft turned into a robbery). He needs a good lawyer. How do I choose the best lawyer?

    Elliot’s Answer

I am assuming they are making this a "robbery" is because he tried to run away when he was caught. That is considered an Estes Robbery. Should definitely be fought. To answer your question, you should speak to a few attorneys, read any client reviews they may have and read about their victories.

    Elliot’s Answer

Worse case scenario is 180 days in county jail. That usually doesn't happen. A good attorney can get this thing either dismissed (through diversion) or lowered to an infraction. Don't settle, speak to an attorney first.

  • I got a DUI over a year ago and served my time in jail. However I started but still haven't finished the 3 months of DUI classes

Now I have a warrant for not finishing the courses. (it's a pv) What can I do to not face more jail time and get reinstated? If I set up a court date will they still take me in, or how can I set it up to see the judge and get sentenced the same ...

    Elliot’s Answer

You have a few options, to try and avoid being taken to jail and getting the bench warrant recalled, you can hire an attorney to go in there and recall and quash the warrant and get you re-enrolment papers. If you cannot afford an attorney, you will HAVE TO go in yourself to get this done.
