    I would contact a lawyer who is licensed to practice in the State of Washington and who has experience in civil rights cases. Whether or not you have a case is going to depend on your state's laws and will likely hinge on what the officer has actually been saying, who he's been saying it to an whether he was acting under color of authority when doing so. I certainly don't agree with the advice that you should ignore this matter as we are talking about a law enforcement officer who states that he is going to "handle you." I don't know the facts of your case or whatever matters arose between his officer and your brother but a law enforcement officer making threats causes a higher degree of concern than the same blather being offered up by Joe civilian.

    First off, I want to state my deepest regrets about the outrage you had to endure. You are an extremely brave person for pushing this forward. You need to contact a lawyer as soon as possible. It is likely that both your federal and state rights have been violated and that you have substantial (and I may add extremely important) claims against the deputy and possibly his supervisors and/or the Department that allowed this nightmare to occur. Given what you wrote, it appears that this may be a policy that is tolerated by supervisors or the result of inappropriate training. Though you have not mentioned the date of the incident and it is the policy of my office not to give advice on statutes of limitation until I have spoken directly with a potential client, please act without any delay in seeking legal counsel as you may have important issues with statutes of limitation that could limit your right to bring a lawsuit. I would be interested in discussing this case with you. One would hope that similar lessons learned by other departments would have filtered up to Kings County so that they would train their deputies to avoid sorts of violations that you endured.
