  • Get an EIN for a Club

I am the current treasurer of a club, the Board of Directors would like to apply for a non-profit status with the IRS. My first step is getting an EIN but the application is asking for my SSN. I don't want to link my personal SSN to the club. ...

    Jay’s Answer

YOu need to have a frank discussion with the board and consider consult with a local attorney. The minimal expense up front will save substantial headache and potential penalties down the line. Generally the IRS requires a responsible party. , “responsible party” is the person who has a level of control over, or entitlement to, the funds or assets in the entity that, as a practical matter, enables the individual, directly or indirectly, to control, manage or direct the entity and the disposition of its funds and assets.

You should find a local business attorney to structure this agreement for you.

  • Can I press charges against someone that I know stole my wallet despite the fact that the act wasn't caught on camera?

I don't have video evidence of the act but I have witnesses along with myself who can testify that a certain individual stole my wallet with cash and forms of identification. I already filed a police report against the individual and the police sa...

    Jay’s Answer

Whether or not to press charges is not up to you. If you have reported it to the police, this is all you can do.

You can bring a civil lawsuit, if you know who the person is and where to find them. This would be a matter for small claims court, although you could consult with an attorney on how to address this.

  • Can I have a business as an llc and a 501c non profit?

can I have a business as an llc and a 501c non profit?

    Jay’s Answer

An LLC is a type of corporate formation, which can do different things. Generally nonprofits incorporate under NRS 81 or 82. You should certainly consult with a local business attorney who can advise you. If it is a charitable enterprise, some attorneys may offer a free or reduced price consult.

  • How do I legally transport guns across state?

I'm moving from NY state to NV (Las Vegas). I have a hunting license, I have two guns - a shotgun and a rifle - which are both kept in a safe. The bullets are in a second, smaller safe. I will be driving from NY to NV - do I need something spec...

    Jay’s Answer

While it is generally permitted for a firearms owner to transport unloaded and secured firearms across state lines, you should check the laws for each state you intend to travel across. Some states (NY, NJ, Illinois etc) have more restrictive regulations. I would not be as worried about the shotgun, but if the rifle might be considered an "assault rifle" you may need to check in more detail. In any event the firearms should be kept in the trunk, or inaccessible to the driver.

Once you get to Nevada you do not need to register firearms (long guns - hand guns must be registered in Clark County). You do not need a hunting license to possess firearms in Nevada, although hunting permits (actually hunting animals) is a different inquiry altogether.

    Jay’s Answer

Generally, under NRS 118A.290, a landlord has to fix problems within 14 days. If the problem concerns essential services (heat, A/C, water, gas), then the problem must be remedied (or best efforts taken to remedy), within 48 hours. However, the statute provides for an exception if Saturday, sunday or a holiday is within this period.

Does anybody know if Walmart has a mandatory arbitration clause for consumer disputes? A walmart auto mechanic employee grabbed my iphone out of my hand while I was shopping because he thought it was cool and wanted to touch it. He got grease all ...

    Jay’s Answer

If you sent a letter to the store making a claim, this should be sufficient. Your best bet is to file in small claims court. This venue is set up to make it easy to file a claim and resolve disputes. You can appear on your own but Walmart has to send a representative. You can hire an attorney if you want, but there is a self-help center with Regional Justice Center than can point you to the appropriate forms.

You will need to see the contract. Ask them for a copy. As the contract is for over one year it must be in writing, and if they can't produce a copy there is no contract.
