    Without reviewing the alleged defamatory email statments, it would be nearly impossible for any attorney to ascertain whether the emails were indeed defamatory and/or harassment.     I am unclear if this trial is for the criminal matter/citation with respect to the person that hit you or if this is the trial for your personal injury complaint for damages against him/her. Regardless, you should be present and attend.

    Each law firm has their own retainer and contigency fee agreement, so I can't comment on another law firm's retainer agreement. In my law firm, we would take this case on a contigency fee base and the attorney fees would be negotiated on a case-by-case basis. Additionally, I (and generally most attorneys) would at the very minimum seek the max amount from the person that caused the accident (or their insurance policy), while at the same time trying to reduce the medical bills and liens.     The answer to your question is generally "yes". You would know by either your attorney and/or the court letting you know the charges were dismissed.

    You have a warrant out for your arrest so I suggest you take care of that prior to your travel to the US. The airport authorities may or may not have access to your warrant.
