Outcome:Ninth Circuit denied qualified immunity and remanded the case for trial.

Description:Wrongful death action by the Father for the loss of his son who died as a result of compressional asphyxia. The son was handcuffed and repeatedly tased, struck by a baton and dogpiled by the police. They got off of him when they realized that when he said that he could breathe he was exaggerating. He died after being attacked in his home, in his room and in his own bed.
