    My motion to dismiss the lawsuit was granted
    Description:
    Case No. CV2010-010261 in Arizona. The bank's loan agreement required disputes over the loan agreement to go to Arbitration. Despite the provision, the bank sued in Superior Court. Our firm discovered the provision and I drafted a motion to dismiss. That motion was granted and the bank was not allowed to sue. Our clients gained the upper hand in subsequent negotiations.

    Description:
    Case # CV2010-018443. Bank sued the client for a deficiency judgment after foreclosing on commercial real estate. After my Law firm's Answer to the Bank's Complaint, I was able to enter into settlement negotiations. The lawsuit was placed on hold to pursue settlement. The case was settled for an amount much lower than the client had expected.

    Lender stopped pursuing foreclosure
    Description:
    Case # 09-06839 in federal bankruptcy court for the district of Arizona. Home lender filed a motion for relief from the automatic stay to foreclose on my client's house after denying his home loan modification application. My client was qualified for a loan modification under HAMP. I wrote and filed a comprehensive Response motion to the lender's motion. After reviewing my Response, the lender stopped pursuing its right to foreclose and reopened my client's modification file to get him approved so he could keep his house.

    Description:
    Case # CV2010-027566. Bank sued my client for a deficiency judgment after foreclosure of residential land. I sent a letter of intent to settle and obtained an extension on my client's filing deadlines (saving the client legal fees). I negotiated a settlement which was better than the client expected.

    Foreclosure sale on my client was rescinded and he got his home back
    Description:
    Bank improperly foreclosed on my client's home while client was being reviewed for a HAMP (Home Affordable Modification Program) modification. Allen Butler wrote letters demanding that bank undo the foreclosure and detailing the various violations by the bank. I coordinated the reversal of the foreclosure sale and the return of the home to my client. I ensured the appropriate legal documents were filed to complete the process

    Description:
    Commercial center where my client leased space was losing tenants, losing customers, and was not being properly maintained. I sought a permanent reduction in rent for my client. I negotiated a lease amendment which lowered my client's rent down to the current market rate.

I negotiated with the landlord to get my client's business rent reduced down to the current market rate.
