There are a lot of issues at play in your accident and treatment. Sorry to hear about the accident, that is never a fun situation to be put in. One of the things That a good personal injury attorney could do is assist in getting providers to deal with bills and to reduce bills. I would be more than happy to spend an hour on the phone with you going over these issues and provide you with my opinion and recommendations. There are more questions raised than I could answer in this reply box.

If the agent failed to get you the insurance you requested, and paid for, you could bring a negligence action against him. It would be your job to prove that he did not follow your instructions, and that you paid for the insurance you requested.

It sounds like you have enough evidence of the accident to win. You would need a detailed estimate of the repairs from a good body shop. Small Claims Court is generally fast and would be a good fit for your case.
