    Edward’s Answer

In Idaho, child support is established by the Idaho Child Support Guidelines that appear under Rule 6(c)(6) of the Idaho Rules of Civil Procedure. According to the rule, an equitable calculation of support is the goal. As such, it will depend upon the full facts/details of your case. I am attaching a general informational link to the ID child support guidelines.

  • Grandparent's Rights, do they have any grounds to sue me for them? I do allow them to see the kids but they have a life too!

My children's grandparents are demanding to see the kids once a month for a two night stay. My wife passed away 7 years ago. The kids have visited with them every month or sometimes every two months. No set schedule. As the kids are getting older ...

    Edward’s Answer

It depends on the facts that are presented to the court. Laws vary by jurisdiction, but as a general observation there might be something in Wisconsin, under sec. 767.43, wis. stats., that permits a grandparent to petition for establishment of visitation rights. You should consult with a licensed Wisconsin attorney regarding the specifics of your case. I am also providing a link to a general informational article about grandparents rights in WI and a link to sec. 767.43, wis. stats.

As a general observation I would recommend that you consult with a local injury attorney about the facts of your case and would not jump to conclusions on the value of your case without talking to a skilled injury lawyer.

As a general observation - inform the court of your situation. I would highly recommend that you consult with an attorney; if you can't afford a custody lawyer, call the state bar and/or a Florida Legal Aid office to see if a volunteer lawyer might be able to meet with you about the specifics of your case and assist you with your court filings. A skilled custody attorney may be able to help in providing you legal options regarding amending the custody arrangement that is currently in place. Best of luck.

  • If I marry an illegal immigrant and he is deported, how do I go about getting a divorce if I cant afford a lawyer?

Married in Florida, reside in Portland Oregon.

    Edward’s Answer

I would recommend that you consult with Legal Aid and/or the State Bar there is Oregon to see if they might be able to provide a volunteer lawyer referral to discuss the facts of your case (including residency requirements for filing an OR divorce). You need to talk with a lawyer about the specifics of your divorce case. After you've met with an attorney you should be better informed on how best to proceed.

I don't what forms to fill out or how to fill them out. I want 1/2 his 401k and alimony. How do i do all that? Help please! !!

    Edward’s Answer

This is a general informational forum; you are asking for legal advice and representation. You need to consult with an attorney (and as you note, time is of the essence). You can use the Avvo attorney search tool to find attorneys in your area. Take the papers that you were served to an attorney and discuss with that attorney the specific facts of your case. If you can't afford a lawyer, call legal aid and/or the state bar for a possible volunteer lawyer referral.

    Edward’s Answer

As a general observation, I think there might be multiple solutions. Have you considered filing a complaint with the Officer's Department? Additionally, just because Legal Aid is unable to assist with you child custody dispute (might be due to budget reasons), you may want to consider making some calls to local attorneys and inquire if they might be willing to make payment arrangements or take your case pro bono? Best of luck.
