  • I have an E.T.G. test and I have been using cold medicine the last two days. Should I be concerned?

The last two days I happened to get really sick, so I started using Robitussin for my cough. I called my drug testing center and found out I had an E.T.G. test. I checked the bottle and saw it had alcohol as one of the ingredients. I called my pro...

    Kent’s Answer

You will most likely be fine. The amount of alcohol in over the counter cold medicine is very low and it shouldn't show up if you were taking the appropriate dosage. You have done the right thing in talking to your probation officer about it already. If you have been otherwise compliant on probation I would be surprised if your probation officer filed a Complaint to Revoke Probation.

  • Is there a way to get a DV harrassment charge and the required protection order dropped?I didn't want him arrested or charged!!

An argument got heated and my fiance grabbed me by my shoulders. He didn't shake me or shove me or hurt me in any way and i didn't call the police, a bystander did.We were in the parking lot of a 7-11 trying to fix our broke-down truck. When the pol...

    Kent’s Answer

There are things that can be done to encourage the District Attorney to drop the charges and the protection order, but there is no magic formula. Charges are dismissed based on the evidence, the applicable law, and having an experienced defense attorney that can articulate your side of the case to the District Attorney. Your fiancé is facing county jail time and the possibility of going back to prison for violating his parole. I'd recommend you hire an attorney as soon as possible or have your fiancé seek representation from the public defender's office.

  • What's likely going to happen?

Heres all my charges this is a first time offence I plan on pleading guilty. DUI possesion of marijuana 2 Oz or less posession of marijuana concentrate 2 Oz or less minor in posession driving 51 in a 40 and a traffic violation

    Kent’s Answer

Mr. Garrett is correct. Don't plead guilty without having your case thoroughly evaluated by an experienced DUI attorney. You will have no idea if your case is defensible or if the plea offer made by the district attorney is fair. Many attorneys on avvo.com offer free consultations. Give some a call.

  • Got a DUI on my moped(50 cc) What are my chances of fighting it.

Officer claims I was weaving and pulled me over. Blew a .093. But also took a blood test with results still waiting. It was also my birthday.

    Kent’s Answer

My colleagues are correct. You should contact a DUI attorney to fight the charges and protect your license immediately. On the western slope it doesn't get any better than Luna Law. I'd recommend you give them a call.

  • I am on unsupervised probation for a DUI and i recently just got pulled over without a license what is going to happen?

i have avoided getting my license beck only because i can't afford interlock.

    Kent’s Answer

My colleagues are correct. You will not get electric home monitoring in Fort Collins and don't believe what the police officer told you about not going to jail. Contact a defense attorney for a free consultation at a minimum.

  • I had to do 180 hours of community service. I didn't do any of the hours. I have court tomorrow. What is going to happen?

I had to do 180 hours of community service. I didn't do any of the hours. I have court tomorrow. What is going to happen? I had four years to complete the community service. I did all the community service on my other case and i was let off proba...

    Kent’s Answer

You should go in to court today and ask for an extension, but you might not have any luck getting one granted being that you had four years to get your community service done. If you had a warrant out for your arrest for not completing your community service that means that the District Attorney's Office filed a complaint to revoke your probation. You may be looking at jail time depending upon your criminal record, the original offense to which you plead guilty, and the particular district attorney handling your case. It would serve you well to talk to a defense attorney to help you sort this all out.

  • I got a felony class 3 for burglary ..also fist time felon .. the D.A told me that if i finish probation the felony off record

i just turn 18 and still in school ...plus the things i stoled were returned it was during the day and nobody was home

    Kent’s Answer

I'm confused as to what exactly your question is. It sounds like the DA has offered you a deferred judgment and sentence. Are you wondering if you should accept the plea offer made by the DA? No one will be able to advise you whether or not you should accept any plea offer without thoroughly reviewing all of the evidence first. I can tell you that you are facing very serious charges that could affect you for the rest of your life. Do not accept any plea deal without speaking to an attorney in person first.

  • How do I defend myself against an unlawful sexual contact charge?

On April 1, 2013, I went to a dentist's office in Boulder, CO to have my teeth cleaned. Shortly after arrival I was taken back by the Dental Hygienist to begin cleaning my teeth. Although the room was open, there were barriers so no one could di...

    Kent’s Answer

In no way should you try and handle this matter yourself. Defending sex offenses is very specialized work even for an experienced criminal defense attorney. It sounds like your case may be very defensible, but there is too much at stake to handle this matter on your own.

    Kent’s Answer

The "lady" that never called you back is Kimberly Weeks. Call the DA's Office and ask for her and explain the situation. She may be able to help you out and maybe the judge will cancel the warrant.
