    Tough situation. The insurance companies are going to point the finger at each other if they haven't already done so. Your wife will need to "apportion" the damages for each accident. Basically, the insurance company doesn't want to pay for the damage caused by the other accident, but determining the extent of the damages can be very tricky.     Insurance companies often live by the motto delay, deny, defend. I think it is a very good idea to include a date in the release when payment will be received. I usually give them 14 days after the release has been signed and received. That gives them more than enough time to draft the check and send it to you.

    We have sued Walmart several times. They tend to be difficult and evasive prior to litigation. You need to contact an attorney immediately in order to protect your interests. Your case is a "premises liability" situation and you must be able to prove that Walmart knew that the dish soap had spilled, or Walmart should have known about the spill and protected/warned you about it.     I'm assuming that the at-fault driver's insurance company's claims adjuster doesn't want you to "double dip," but the law states that the at-fault driver is required to pay for the total amount of damage that he caused; however, there are two ways to get the money, by asking for it, or taking it---filing a lawsuit. Adjusters will give you want you demand if you can show them what you are owed. Figuring out exactly what you are owed for the at-fault driver's negligence can be very complicated....

    Plead not guilty and get a court date set. Show up at the Court on the trial date and ask to talk to the DA. Tell him why the citation should be reduced to a 2 point violation and explain why. DAs are more inclined to reduce and not go to trial if you have a legitimate reason.
