    Obviously the bad guy was the driver of the Monster Van. The first thing I would do is request the official Traffic Accident Report. Monster's insurance company probably already has it. If the driver was cited, then Monster's insurance company may admit "liability". That means they understand they are on the hook to pay the damages.     If you feel like you are being cheated, you are probably right. Don't take it personal, the insurance company doesn't really care about you, it is just business. Their goal is to pay you the least amount possible. Sometimes people are so frustrated with the process that they give in and settle. This is your life and you need to do what is best for you and your family. I don't want my clients to have any regrets. If you settle for that amount and next year, or the year after, or down the road you think that you should have received more, it will be too late. Most of these personal injury lawyers will give you a free consultation, but you need to answer two questions with or without an attorney--what is my case really worth and how long is this going to take? If you receive the maximum and you do it right; hopefully, you will feel that it was fair. Think this through thoroughly. Good Luck to you!

    It is possible that you don't need an attorney, but it all depends on the policy limits of the gal who caused the crash. In Colorado, the minimum is $25,000.00. If the gal who hit you only had $25K, then you should demand that and Progressive should pay you the policy limits. Ask Progressive what the policy limits are. But, you really need to make sure what is available before you sign anything so that you don't have any regrets down the road. You might also be surprised that there are other policies that may cover your damages. Any of these attorneys will give you a free consultation so that you can sort out these issues including us. You should find a straight shooter that you feel comfortable with, especially because it these injuries may not get better. Your damages far exceed $3,600.     That is very frightening. You certainly have a case. I agree with the others, call the police. It is a lot easier to negotiate your case with the insurance company when the police have conducted an investigation. You should be paid, at minimum, for your property damage by the property owner.     You should not have to pay or "eat" any of your bills. She cannot simply say it was an accident and she doesn't have to take responsibility. It doesn't work like that. If she meant to hurt you then it is a criminal case. If she didn't mean to hurt you then you must determine if she was negligent. You stated that she came around a blind corned and hit you in your lane. If we can prove those facts, then you win the negligence claim. Now you must find out what is her ability to pay for your damages. You would be surprised on the number of different insurance policies that could cover you. You have to be careful, because sometimes there isn't insurance coverage and the person who caused the injuries, damages, and losses doesn't have a whole lot. I ride a lot and was hit as well. Fortunately, the person who hit me had the right coverage. You have options. You should receive your lost wages, all of your medical bills, inconvenience, loss of enjoyment of life, future medical expenses, property damage, and permanent disfigurement. There are many good attorneys that can get you back on track, including us. Reach out for a free consultation as soon as possible so that you don't jeopardize your rights.     Sorry to hear about your situation. Last year we sued a nightclub and received one of the largest verdicts in Colorado history, and our client was charged and convicted of trespass---we still won. You situation is sounds all too similar. These bouncers do not know how to control themselves. They have a little bit of authority and they rage out of control. They can be really dangerous people. You can and should prevail. You need to meet with an attorney who you feel comfortable with. Most attorneys will give you a free initial consultation including ourselves.     Sorry to hear about what happened. If the family member has not been charged it is unlikely that the state program for victim assistance will be available, but you still have rights. The bad guy/gal needs to be responsible. There are a number of ways to get your damages covered; however, you have to do it the right way or you may get nothing. If the bad guy/gal was intoxicated home owners' insurance may cover your damages. Again you must present it the right way. Most attorneys will give you a free consultation, ourselves included.     Yes, you do have options, but you need to pursue those options the right way. We recently represented a gentleman who was charged and convicted. He couldn't find an attorney to represent him. We agree to represent him and we won. These insurance companies will use every excuse to get out of paying what they should. You need to get treatment right away. If you don't have health insurance there are medical providers that will treat on a lien. Call right away and make sure you explore all your options. Good luck.

    In your situation you have to show that your doctor provided care below the "standard of care". Basically, you have to show that another, reasonable, doctor would have treated you differently. If she were to prove that there are side effects of this procedure, or your body responded differently, then she would win. The hardest part is finding another doctor that can identify malpractice, and why. Feel free to call to discuss.
