David Frank is based in Austin, Texas and has a reputation for being a tough and experienced criminal trial lawyer. In April of 2014 he successfully challenged the Texas Mandatory DWI Blood Draw Statute. The Court of Appeals reversed the trial courts in his two cases and found that the Mandatory Blood Draw Statute runs afoul of the Fourth Amendment warrant requirement. In November 2014 he helped lead a State-Wide effort against a SOAH rule change that would have significantly hampered the right to subpoena witnesses for ALR Hearings. In December, Mr. Frank won an ALR Hearing where the SOAH Judge found that the arresting officer's testimony was not sufficient to prove reasonable suspicion for the stop.
