    An appeal is much different from a 'new trial' -- and yes, you need to show up if there's a hearing (oral argument). It's possible there will only be briefing, but I recommend you get an attorney no matter what; they will almost certainly have one. You're right: typically no new evidence is allowed. How long it takes for the court to decide is anyone's guess; depends on a lot of factors.

    You don't need to find other people; you need to talk in more detail with an attorney who handles class actions, so that he/she can help you determine whether you have a case.

  • Did not get paid for 45 days.

    Hello, I get paid on 15th of every month. I resigned my a job on May 01, served a notice of 2 weeks. I was expecting salary of one and half month but I did not get any. Can somebody assist me on what I should do going forward?

    Definitely file a claim with Texas Workforce Commission if they owe you wages.

  • Can I sue a person for slandering my name, harassing, and stalking me in and outside of the work place.

    More details are needed, but if someone has made false statements about you, that have caused real harm -- and they aren't just statements of "opinion" -- then you might have a good defamation claim.   • Is it legal for a co worker to secretly use a recording device, to record a conversation of another co worker? I'm in Texas

    Our company handbook says that it is not permitted, along with taking photographs, unless you have permission from our hr office. I'm definitely sure this person does not.

    Texas is a "one party" state, which means it's ok to record conversations, etc., as long as one party consents -- which means one party can record another party as long as the person who is recording is part of the conversation. But 'what is legal' is different from 'what is ok according to company policy.' Sounds like you might want to talk to HR.

    Doesn't sound legal to me. If they continue to refuse to pay you, consider filing a complaint with the Texas Workforce Commission.
