  • What can I do if the police didn't read me my Miranda rights?

Police caught me and friends at the lake in my friends car and they found a sack of weed, 1 xanax pill, and a pipe in the car and just arrested me. I asked what the reason for my arrest was and they said "so that isn't yours?" After I was put in c...

    Kathryn’s Answer

You can see if that fact effects your case after your Attorney has received all the discovery and evaluated if it makes a difference or not into what the State can prove. You also can get google Miranda and educate yourself what that means to your rights and prosecuting a case.

  • I have a friend that is in jail for probation violation. Is their anything that can be done to get him out of jail?

He quit reporting about 6 months ago.I believe its felony probation.

    Kathryn’s Answer

Yes, if the Judge set a bond he can be bonded out. If he is on a felony case and picked up a new Felony case the Judge can issue a no bond. These questions will can be specifically answered by his Attorney as we on this website do not have specific info and are merely guessing.

  • My wife told police I threatened her.I said I didn't but was still arrested and released the next day and given a court date.

If she doesn't come to court will the fine/charge be dismissed since it was a my word against hers type of thing. I also received a letter from the courts saying an ammended complaint was filed.

    Kathryn’s Answer

No there is no such a thing as automatic dismissal if the complainant does not show up for Court. The only time the complainant would be required to show for Court is when they are subpoenaed. You should consult with a Criminal Defense Attorney asap to help you navigate through the criminal justice system.

  • My 26 year old daughter has a court date in Huntsville, TX for possession of a dangerous drug and public intoxication.

She is bipolar and was not on her meds. She went to a Walgreens, was angry and started throwing products on the floor and cursing the clerk. They called the police and she was arrested for public intoxication and possession of a dangerous drug. ...

    Kathryn’s Answer

A judge is the gate keeper of cases. Your letter will be filed and not read. The Judge will take no action even if he/she had read the letter. If you can not afford an Attorney the court will appoint one to your daughter. Until the case is set for trial all work is done between the prosecutor and defense Attorney. It is not advisable to post specific facts on this website as prosecutors read the posts and have access. best to consult with a criminal defense lawyer, most have free consultations and a flat fee with payment plans. You can find one in your area by looking under find lawyer tab above. Good Luck

  • I have an harassment charge. Been to court 5 times last two where suppose to be jury trials. First one was a reset & the second.

Well to say the least it was strange. My court appointed attorney was the first one there. He's always late! He told me to leave without signing anything. I asked what's going on & he said " going to be a continuous your free to go" the following...

    Kathryn’s Answer

Your lawyer I bet has several other courts to attend to that are set at the same time. so he/she is running from court to Court handling cases. so what you think is late is on time in another Court. Judge's and prosecutors are aware that all defense Attorney's are in several courts during the day. I'm wondering if you were aware of that? Do you know how many cases were set for trial that day? Do you know how many were set ahead of you and that's why your case was continued? Having your case rescheduled is legal. Being arrested for stalking is legal. Does your attorney know about the stalking case? Bet he doesn't have a clue, you should tell him because law enforcement rarely calls a Defense Attorney to tell them their client is being arrested.

    Kathryn’s Answer

Has your son asked these questions of his Attorney? Does the Attorney have all the discovery he need/ Has your son's Attorney talked to the prosecutor? No Attorney on this general information website has specific knowledge of your sons case. You should also know that prosecutors read this website and it not advisable to post info they may not know and can figure out who you are. Always consult with your attorney first before
doing something that can possibly sabotage your son's case.

  • How long can a jail hold a person waiting to go to the SAFP program?

My friend was sentenced to SAFP for DWI's and has been in jail waiting a month to go to the SAFP program. How long can a jail hold somebody waiting to go? I recently found out about a man who waited 7 months in jail for the SAFP program?! My frien...

    Kathryn’s Answer

Ihave never seen a Judge put someone in jail to get behind on their child support. SAFP is long term treatment for serious substance abusers. One DWI won't get you into SAFP, 2 or more DWI's will. There are many across the state waiting for a bed. I suspect there is much you do not know about your friend, his substance abuse and his case.

Your charges can always be dropped but not because you weren't indicted within 90 days. Read section 17 of the code of criminal procedure.
