    He was under the influence of drugs and alcohol at the time. He did not hurt anyone. He is also seriously mentally ill.

    A lot of factors are important...including but not limited to the facts, the prosecutor, and the judge. The Dallas County Public Defender's Office has a mental health division. You may want to ask your husbsnd's lawyer about that our to look into that option.

    It sounds like there maybe some misunderstanding. You only enter a plea if you want to and the lawyer cannot do a plea on your case without your presence and approval. You need to contact your lawyer immediately to discuss all of your rights under the law and what you want to do with your case. Never do anything you do not feel comfortable doing. It is always wise to ask all your questions as soon as they come up. Stay calm and contact your lawyer.

    Wait for the celebration on the first day after the 2 year statute of limitations runs. If it does get filed you may have a Speedy Trial issue. You should consult a lawyer about that one the case gets filed. Make sure not to speak about any details of anything with the bond supervision person either. None of those people shall be trusted.

    You need to hire a lawyer as soon as possible. You should find someone seasoned in criminal defense and who has experience with these types of child sex cases. Always be up front and honest with the lawyer you choose, because if your not it will be to your detriment.

    Yes it is counting towards the person's time. When they get to a TDCJ unit is not relevant towards the time. Their back time is also included but does not include any special credit...meaning they don't get the 3 for 1 credit that the Dallas County Sheriff provides.

    Anything is possible but it all depends on the facts of your case. You should definitely consult with a criminal defense lawyer to discuss the facts and your options. But, you should never expect a dismissal without putting up some sort of fight.

    Usually the unit parole officer should be providing a letter about the parole vote and the type of decision made. Sometimes it takes awhile for the response to make it to the offender. If the parole vote was made a while back and your husband still has not received a letter. You should contact the Board of Pardons and Parole and let them know of the situation. Also, Senator Whitmire would be a good person to notify of your problem.

    Disciplinary history is very important in whether an offender gets their early release. They look at the type of disciplinary issues, the frequency, the dates, and the facts listed in the write up. He needs to "stay clean" from here on out if he wants a better chance to get out early. If he can't act right while in custody the review board will assume he is not ready for early release.

    They District Attorney has two years from the date of the offense to file a criminal case. It is wise to consult with a defense lawyer to make sure a case has not been filed yet and attempt to get some sort of agreement in writing that if she pays the civil demand that charges won't get filed in the future.

    They won't put you in jail unless you choose to go to jail by signing for a plea that includes a jail sentence or if you skip out on court (they will issue a warrant for your arrest). It is wise to make sure you make it to all of your court dates and check in with your bonding company so they don't try and jack with your bond (only relevant if you do have a bondsman or bonding company who paid your bond).
