    Practice Area:
    DUI & DWI
    Date:
    Mar 11, 2011
    Outcome:
    NOT GUILTY
    Description:
Client was pulled over with his shirt off driving 65/35 on Montrose. According to the officer, failed the SFSTs at the scene. Was arrested with an open Budweiser in the console. Very lethargic and forlorn on the video. Then threatens to kill the f'n officer afterwards. Jury could not desipher beyond a reasonable doubt between client's mental illness and intoxication. They followed the law and did the right thing.
  • State of Texas v. R.M.

    Practice Area:
    DUI & DWI
    Date:
    Oct 05, 2011
    Outcome:
    NOT GUILTY
    Description:
DWI 1st in Fort Bend County #3. Full refusal, meaning client refused all the tests and breath or blood testing. Took FBCSO 23 minutes to figure out if they shoudl arrest him. The DA offered us a class C open container ticket and dismiss the DWI. Client had the balls to trust in me and we were found Not Guilty. Ft. Bend is famous for not just dismissing cases, they always want you to plead something. Not me!!
  • State of Texas v. W.T.

    Practice Area:
    DUI & DWI
    Date:
    Dec 06, 2011
    Outcome:
    NOT GUILTY
    Description:
0.172 breath test! He was a veteran who lost his foot in Iraq. I was not going to let him go down without a fight. I also tried his case for free (that's my military discount). The State finally dismissed his case right as I was about to destroy it. Huge 15 minute violations, Bullcoming problems, Erdman issue. The DA did the just thing by dismissing it, but it dhould've been dismissed before trial. So, we put their feet to the fire and tried it. 1000 ways to skin a cat, and I'm gonna try every single one.
  • State of Texas v. C.R.

    Practice Area:
    Criminal Defense
    Date:
    Dec 06, 2011
    Outcome:
    DISMISSED
    Description:
Failure to register as a sex offender. Crazy neighbors and a crooked cop turned him. But it was complete bs. Took setting it for trial, for the DAs to realize I wasn't backing down and not taking any bs deals.
  • State of Texas v. M.H.

    Practice Area:
    Criminal Defense
    Date:
    Dec 12, 2011
    Outcome:
    DISMISSED
    Description:
367 lbs of Marijuana. Client was caught running when the narcs busted down the door. However, he never had care custody or control of all that weed. No affirmative links to that much weed. Just in the wrong place at the wrong time.
  • State of Texas v. A.A.

    Practice Area:
    DUI & DWI
    Date:
    Apr 24, 2012
    Outcome:
    NOT GUILTY
    Description:
Client was a hispanic arrested for DWI after an accident at 90 mph. However, it just didn't add up with an unreliable witness that suffered from PTSD and police officers eager to bust people on Cinco De Mayo. Jury did the right thing and found client Not Guilty in 3 minutes. Quickest verdict of my career.
  • State v. E.O.

    Practice Area:
    Criminal Defense
    Date:
    Aug 21, 2013
    Outcome:
    NOT GUILTY
    Description:
0.19 Blood Test! That's the fourth not guilty I have received where the blood comes into evidence and the jury returns a verdict of not guilty. Finally juries are understanding that government machines are not always accurate. For an up to date list of my wins check out www.thetexastrialattorney.com
