Please consult a local probate law attorney! Many attorneys, like myself, offer a free consultation. This is really a probate question, which may need exploration of guardianship, if dad is unable to care for himself.

You have been through enough. MIf the house was bought during the marriage it is presumed to be community property, as is everything bought during the marriage. That means it belongs as much to you as it does to him. You REALLY need an attorney to make sure you and your child are protected. The Judge has a duty to divide the property in a "just and right" manner. However if you have signed any kind of property agreement the judge may sign off on it. Tell the judge everything you have...

You can ask for Attorney fees every time he files, showing that his harassment and draining of your resources is detrimental to your children, as it keeps your financial state near unstable. However, your attorney must offer testimony as to that before a judge to get he judgement. Consider gathering all the ex-wives find a civil law/family law attorney to discuss with the group the possibility of filing suit against him for harassment and misuse of the court system seeking past attorney fees...

It is a risk you will have to face if you file for child support. The child has a legal right to emotional and financial support from both parents which may be interpreted as right to know his parents. when you file for child support, especially from someone who is married, you are opening that door. And unless the father has a record of domestic violence or sex crimes, you will not be able to prevent visits if he requests them. It is also possible that his wife will get into the mix. All...

The cost of representation depends on the experience of your attorney, and the facts of our case. There is no set price for representation. The more aggressive and drawn-out the proceeding is the more hours will be used and billed. Find 3 attorney profiles on this site for San Antonio, and call them. Often the first visit is free or under $100. When you find the right attorney for you, work out a service agreement. Good luck.

The only way you can get past having him served by a process server, or constable is if he will sign a waiver of service. If you are not on goid terms with him it is an investment in your future to have him served. Good luck.

Check the language on your mediated agreement. In Texas mediated settlements are binding. It is highly unlikely that the third party during separation will have status of a substantial change of circumstance that must be proved for a change. Please consult a Family attorney in your local area. Many attorneys, like myself, give a free initial consult and can give you clearer guidance based on all the specific facts of your case.

I am sorry for your loss. I have edited our practice areas as this is a probate/estate law question, not family law. If someone dies in Texas without a will his estate passes through intestacy. If all of his children are of the marriage to the widow, the estate will pass to the widow. If there are children from other relationships the estate will be divided among the heirs (widow and sons). Please consult a Probate or Estate attorney in your local area. Many, like myself, give a free...
