Aggravated Kidnapping

Richard E. Carrizales

Case Conclusion Date:December 14, 1912

Practice Area:Criminal Defense

Outcome:Case No-Billed by Dallas County Grand Jury

Description:Case involved a 17 y/o young man who was accused of kidnapping a 16 y/o girlfriend and threatening to kill her if she did not go with him. The Defendant took the young girl, her baby and younger sisters on a high speed car ride and refused to take them home. He later dropped the younger sisters and baby at a stranger's home in Southwest Dallas and then took the 16 y/o girl with him. The younger sisters told the police the Defendant was pushing and draging the girl to the car before he took her with him. Later after a kidnapping alert was put out the Defendant was arrested running from the girls home by the Irving Police. I did a videotape interview of the girl and burned to DVD and presented to DA including a written packet arguing for the Grand Jury to throw out the case for lack of sufficient evidence of an Aggravated Kidnapping. Also prepared the Defendant to testify before the Dallas County Grand Jury. Result was that case was No-Billed (Dismissed) by the Grand Jury on December 14, 2012 and Defendant was released from custody. By actively working on the case before Indictment, I was able to get all charges thrown out at the Grand Jury level and avoid a possible long term jail sentence and the Defendant having to wait in jail for possibly up to a year before the case might proceed to trial. the Defendant's bond had been set at $100,000.
