    All cases depend on the facts, but provide notice to your insurance company. Just because you are sued doesn't mean that the person will be successful. Ask questions to the insurance company and insist that they defend and protect your rights. It doesn't sound like you had an attorney to handle your own injury claim and it is always advisable to consider having and attorney to handle your injury claim. Perhaps in some cases representation can keep you away from these possible unjustified lawsuits.

    You need to consult with an attorney in your location as representing yourself in such an informal situation may not produce all the damages that you may be entitled to such as loss of use or substitute vehicle and in some cases loss of value to the vehicle even if repaired.
