  • Injury lawyer settled without me knowing

He showed no settlment docs and when i asked for the money he sent me a personal check.

    Clifford’s Answer

Your attorney is not authorized to resolve a claim without your authority. However, the settlement he entered into may still be binding upon you. I agree with the other comments. Get an accounting and determine if you agree with the terms of the settlement. If you don't, I suggest you contact another lawyer and the Illinois Disciplinary Commission. Note that it is also improper for the attorney to place the settlement funds into his personal account.

  • Can i change lawyer due to this w/o a large fee? also the time change was 3 wks before & clocks were wrong. i'm worried

i was involved in a bad car accident last year. this case will be going to court this fall. i have concerns regarding my attorney. there was a lady who witnessed the accident in my favor. as the months went by i wanted to thank her for stayin...

    Clifford’s Answer

Yes. you can change lawyers. Illinois law liberally permits changing of lawyers. If you have lost trust and confidence in your lawyer, then you can change lawyers. The previous lawyer will be entitled to an hourly fee for his work. This will then be subtracted from the 1/3 contingency fee that the new attorney will earn. Hence, there will be no harm to you. You will want to make a copy of your medical records and the depositions and have another attorney look at it before you discharge your lawyer. In this way, you protect yourself.
