  • My wife wants a divorce because she doesn't want to be married anymore but I want alimony

But the thing is we are paying a mortgage and a car note a we have 2 dogs and she makes more money than me

    Judy’s Answer

You have not asked a question but have put forth several facts. You need to speak in person with one or more divorce attorneys and hire the one you like the best. It may be possible that you will be entitled to maintenance but that along withdisposition of the marital assets and liabilities and all other issues will be discussed and resolved in court with the help of your attorney.

  • What kind of attorney do I need

My gfs ex is accusing me of fondling her daughter. He filled for a restraining order, I have 7 days to respond

    Judy’s Answer

Good grief! You need a criminal defense attorney ASAP. The attorney should also know how to handle defense of Orders of Protection. It is very possible crimnal charges may also be sought. You should refrain from any discussion of this matter here or anywhere else in public or even in private except with an attorney.

  • Custody question

how is a 604b custody evaluation updated after a 604.5 &215. Meaning can the 604b evaluator redo the entire report acting as a 604.5 and make rebuttals to the 604.5 & 215. Since is standard protocol was not followed (testing, not checking references)

    Judy’s Answer

This appears to be a continuation of an earlier inquiry. The 604b has a duty to update his or her report if requested and paid to do so, especially if the case is going to hearing. The 604b is under no obligation to rebut any other custody evaluation and indeed need not even read it. What you now have is a battle of the experts.

    Judy’s Answer

Your case is far too complex to answer in this simple online Q&A forum. Speak to several lawyers and hire the one you like the best. You may have a strong case for custody but you will not get it by asking what to do here or anywhere else o line. Best wishes to you..

  • Sue Chicago police

District 14 . After 2 months detective don't return a call. I got jumped by a neighbor and my face was destroyed. Detectives have everything to arrest my neighbor and they aren't doing nothing at all on my case.

    Judy’s Answer

You did not ask a question but rather than considering a lawsuit which you most likely will lose, why not speak with the with commander, lieutenant or station chief about the failure to investigate?

  • If a coworker flagellates deliberately in your personal space; you tell them to stop and they continue, is that harassment?

This happened 3 times after telling them not to.

    Judy’s Answer

Do you really mean flagellate or are you trying to say the co-worker is intentionally flatulent in your space? Either way, where are you going with this argument? Even if it is harassment, which is not certain, you may have no recourse. Flagellation, however, is very strange and if that is what you mean, you might consider asking your employer to recommend counseling or at least an alternate location for your co-worker to abuse himself.

  • Do I Need A Child Lawyer?

Girlfriend left 2 months before having my child. Now she changed her number and moved out of state. I just want to see my child.

    Judy’s Answer

You need to act quickly. Hire a lawyer who practices in the county and state where your child is presently located. File an action to Establish Paternity and seek all rights to which you are entitled.

  • I am in a realestate deal with a realitor I need a final payoff figure on my property. he tells me when we get to the closing

he'll give me the numbers. I want to wait I need someone to figure this out.

    Judy’s Answer

The payoff will be made available by your lender and will be a figure calculated to be on or shortly after the day of closing. This is not something you can calculate on your own. The final figure will be made available shortly before closing so that you know if you need to bring any money to the table in order to finalize the transaction. In reality, you would be best served by having an attorney to represent you in this transaction.

  • My mom's lawsuit was settled however she needs to sign probate papers.

She has to sign a form stating that she acknowledges that she has received her distributive share of the estate in full. But she hasn't received the money yet from my brothers wrongful death lawsuit. Why should she sign if she hasn't got the mone...

    Judy’s Answer

Some facts appear to be missing here. If your mother had a lawsuit which was settled, is that a separate case from your brother's wrongful death action? If they are one and the same, she still should not acknowledge receipt of something she has not received. Clearly she has an attorney for the wrongful death case and should receive all advice and guidance from her attorney.

  • What will prevent me from getting into the College of Education for teaching at a university in Illinois?

I know they do background checks when you are going to get a degree for teaching, but what will prevent me from getting admission? I was "arrested" a year ago for a municipal ordiance violation for shoplifting. Will that prevent me from being able...

    Judy’s Answer

If the outcome of your municipal violation case was not a conviction, you can probably get it expunged and/or sealed. You must not lie during the admissions process, but this might be helpful for you: You can seek expungement without an attorney. If and when you qualify for expungement can be reviewed at the following links. For Cook County: http://12.218.239.52/newsite//GI_NEWS//newscontent/Events/2013/Expungement_Packet_2013.pdf or for outside Cook but still in Illinois, go to: http://www.illinois.gov/osad/Expungement/Pages/default.aspx

I would suggest you first obtain a certified copy of the disposition of your case because if you succeed in having it sealed, it will never be available to you again and you might need it in the future to explain your background. You can get it from the Clerk of the Circuit Court where your case was heard. Then file for both expungement and sealing.
