  • If my vehicle was being repaired and we damaged the rental vehicle, can the car dealership our vehicle is at hold our vehicle?

They are holding our vehicle as collateral without first sending a certified notice with the date and said amount for repairs and I have read that is against the law. Is it?

    Jeffrey’s Answer

Have you paid the dealership for the repairs to your vehicle?

    Good Luck.

  • Can I move out any time (after paying rent for two months) if I do not have a valid signed lease for the current lease year?

I am living at a rental property for the past two years. This year, over email, I expressed my intent to renew the lease to my landlord. He mailed be the lease, which I have not yet signed and returned back. It has already been two months into t...

    Jeffrey’s Answer

Actually, you need to review the terms of your lease carefully. By expressing your desire to renew for a year, you may have done that. Although you never returned a signed copy of the lease your assent to the terms of the lease can be implied through other things like making payment and requesting a one year renewal.

That said you may have other ways of cancelling the lease based upon the condition of the premises.

You should consult with an attorney.

    Good Luck.

ON SEVERAL OCCASIONS I HAD STATED TO MY LAWYER THAT I DID NOT WANT A CONTINUANCE BECAUSE IT WILL MESS UP MY SPEEDY TRIAL, AND HE ASKED FOR ONE ANYWAYS. NOW I AM STUCK AND GOTTA WAIT UNTIL SEPTEMBER TO GO TO TRIAL

    Jeffrey’s Answer

I agree with Mr. Scifo. There can be many reasons that an attorney asks for a continuance. Discuss this situation with your attorney.

    Jeffrey’s Answer

I agree with all of the previous posts. You should have your lease reviewed by an attorney. That said, I interpret this to mean you have to pay rent in advance, so your rent for September would be due on or before September 1.

    Good Luck.

You can file a claim under section 5 of the Wage Payment and Collection Act. This section provides in part as follows:

Sec. 5. Every employer shall pay the final compensation of separated employees in full, at the time of separation, if possible, but in no case later than the next regularly scheduled payday for such employee.

    Jeffrey’s Answer

While it is not common, there are situations where you can plead a fraud case along with a breach of contract action. That would need to be in the complaint that was filed. Many more details are needed. You should contact an attorney, or a second attorney.
