You can still divorce someone and serve them with the action in North Dakota even if you can't locate them. There are just good faith requirements that are needed and the costs of publication. With a daughter and the circumstances, it likely would be worth it for you to hire an attorney.

    Jannelle’s Answer

If you want a normal name change, the court has forms to help self represented people, but you will have to notify him of the court action. http://www.ndcourts.gov/ndlshc/NameChange/NameChange.aspx

The California decree could also have an impact on how you go about it. You may want to hire an attorney just to see how you can petition the court but still provide you with protection and abide by the California decree. You should hire a family law attorney to assist you with that.

    Jannelle’s Answer

You could try to file in small claims court. It would all come down to the judge hearing both sides to see what the agreement really was. You should consider whether this person would be likely to pay even if you won or what value the friendship is. Good luck!

  • Abandon Property?

Hey I have a question, I live in ND. We had one of my roommate's coworkers stay with us because she didn't have anywhere to go. She wasn't on the lease and we didn't charge her for anything while she stayed here. She ended up moving out after deci...

    Jannelle’s Answer

I think you need to provide much more in details for answer. The amount, types of items and the value of them are all part of whether you followed the law for abandoned property or if they want to claim conversion. Likely it might be tough to convince law enforcement after all this time, unless they had some proof of attempts to claim it since then (and keep in mind not everyone tells the truth so you don't know what they might say). If criminal doesn't work, I presume the value would be small enough that they would need to take you to small claims court and then both get to tell their side of the story for the judge to decide. You may want to be proactive and just hire a lawyer to send a letter telling the person the facts as you understand them and why you treated it as abandoned property. Or you can wait and see if they do anything.

    Jannelle’s Answer

There is a form that you can do when you apply with the Petition and there's no charge for that part of the application. It's different than your OPT. I assume you are the one who just got married, and I'm hoping you figured out how to get your OPT extended. Good luck!
