Trial court award of custody was reversed.
Tonya Hill successfully challenged the district court's grant of custody of her two minor children to Terrie Sherman. Sherman is the maternal grandmother of the two minor children.
The Court of Appeals concluded the district court failed to properly apply a presumption favoring custody with the natural parent, and that the record did not support the determination that the grandmother was a statutory "interested third party" under Minnesota Statute Section 260C.03.
The Court of Appeals reversed the award of custody to Terrie Sherman and restored full legal and physical custody to Ms. Hill.
