After graduating first in my class from law school, I went on extended active duty for five years in the United States Navy as an Officer in the Navy Judge Advicate General Corps. (I was a naval officer while I attended law school.) I was always ranked a "Top 1%" performer in my Navy officer fitness reports by over 27 line commanding officers and as well as superior officers in the JAGC chain of command.
I served as Staff Judge Advocate to the Commanders of the 19 submarines at the Submarine Base at Pearl Harbor, Hawaii, the Commanding Officer of the Sub Base, and the Admiral, COMSUBPAC (Commander, Submarine Force, Pacific). A heavy trial load in the Navy paid off in civilian life because I have an extremely busy trial practice in the State of Minnesota, and in federal courts around the country. I was on active duty from 1981 through 1985 and left the Navy as a Lieutenant Commander. I then became General Counsel for a large agency of the Department of Defense and supervised a staff of 11 lawyers and 11 staff. In 1992, I returned home to Minnesota to start my own law practice.
My clients have been acquitted in over 15 murder and attempted murder trials. I have won several felony-level narcotics trials in federal court and over three dozen felony-level drug trials, gun trials, assault, and sex trials in state court. I have been successful in getting over two dozen felony cases dismissed in state and federal courts for violations of the constitutional rigths of my clients.
Regarding appeals, in 2011 I was asked to represent a man already convcited in federal court for sex trafficking minor females. In 2012 I won a reversal of his conviction at the Eighth Circuit Court of Appeals becasue of a faulty jury instruction. His 28-year sentence was reversed and my client was awarded a new trial. That case is United States v. Arthur James Chappell. Winning a reversal/remand in the Eighth Circuit is extremely rare for a criminal defendant.
When a deal must be struck, my clients receive the lowest sentences possible. In the early 2000s, a client received no time in a federal case when his sentencing guidelines required a prison sentence of 360 months to Life. In a recent federal case, my client received no time in a case that carried a 10-year mandatory minimum sentence. In state court, I have had a dozen clients get no time in first and second degree drug cases after guilty pleas.

I am admitted to practice in the State of Minnesota, the U.S. District Courts for Minnesota, Nebraska and the Middle District of Tennessee, the Eighth Circuit Court of Appeals, military criminal courts worldwide - both trial courts and appellate courts, as well as the United States Supreme Court.
I have served as the Chariman of the Criminal Law Section of the Minnesota Bar Association, voted a "Super Lawyer;" and voted a "Top 40 Lawyer."

The Tou Fue Moua murder trial, which is the subject of these two articles, resulted in an acquittal. I have been asked to appear on "20-20," the "Doctor Phil Show," and others. I have declined all requests for appearances on these types of shows. I have spoken several times on WCCO Radio about general criminal law topics.
