  • How would splitting these expenses work?

My ex and I split costs 50% for our children as ordered by our divorce decree. Lately, he has been suggesting (what I consider to be) unnecessary expenses and medical treatments just for the purpose of costing me money. The most recent example i...

First, if you have joint custody you must agree to elective items. Second, if you cannot agree as to whether something is necessary the court will make a ruling. Get a letter from the dentist/orthodontist indicating it is elective and send her a copy with your notice that you do not intent to split the cost. then the ball is in her court as to what she does next.

  • On a lease non-renewal, must I give 30 day notice and state a reason for the non-renewal? Thank you.

I do not want to renew a tenant's lease. This tenant has a lease renewal 10/1/15, annual lease. I want to be clear that we are not renewing their lease so I want to send them a non-renewal letter but am unclear as to how much notice I am require...

    Tajara’s Answer

No, you do not have to say why. You should indicate "that your lease will expire on _____, no further lease is being offered and you are expected to have vacated the property by that time."

As to timing, what does the lease say? If it is silent, then your best bet is to give at least 30 days notice

  • Must the father pay child support when the mother and newborn are on badger care and are not married?

The mother also had insurance through her mother and she has no wish to claim the support.

    Tajara’s Answer

If the parents aren't living together, it is likely that the child support agency will initiate an action for support and the court will order a support payment. Mom doesn't get to decide she doesn't want the money when she or the child are on state aid.

  • What should I expect?

Not sure if this is the correct place for this, but here goes. I have a public defender who doesn't seem to care too much. I am charged with 2 counts of SA of a 12 year old girl. I have never been in trouble with the law before and was completely ...

    Tajara’s Answer

You don't indicate your age but these are very very serious charges. You need an excellent criminal defense attorney. You could go to prison for a very long time and you could be forced to register as a sex offender for the rest of your life. Sit down with your public defender and discuss what you should expect with them. If you don't like their plan or don't think they have your best interest in mind, you can request a new one or hire an attorney yourself. This kind of charge is not one you should not be well represented.

  • At what point is an officer required to read miranda rights during owi arrest?

I was not read my rights until after blood was drawn. I was in custody in cuffs for over two hours

    Tajara’s Answer

The remedy if they don't is to suppress any statement you made in violation of your rights; however, if you made no statement (or they don't need the statement to convict you) then their failure is not helpful

  • Is it kidnapping if I pick up my daughter's boyfriend and he comes to our house and then I take him home at the end of the day?

My daughter is 16 and the boyfriend is 15. They have been dating for 6 months now and Boyfriends parents don't approve of the relationship.

    Tajara’s Answer

if the boyfriends' parents don't approve, you shouldn't be interfering with their decision as they could make trouble for both you and your daughter. Any sexual contact they have with each other could result in your daughter being charged with sexual assault and having to register as a sex offender.

  • Can a company require you to be married.? Our company has goals and if you meet them you earn a trip to a different destination.

All expenses paid, just need to pay tax on air fare. But they say you must be married before you can bring spouse. If it's a earned trip why could you bring girl or boy friend if other get to bring and pd for trip for spouse?

    Tajara’s Answer

i think a company can put any rules they want on a bonus...they don't have to accommodate your significant other...what if you didn't have one? then would a friend count. they may have had a discrimination issue before gay marriage was legal but that debate is now moot.
