Description: My client was a co-signer on a secured debt at the time of her divorce. When it was up for renewal, she declined to renew and asked the bank to call the loan due. The bank, without her signature renewed the loan in her name. The Wisconsin Supreme Court agreed that the bank's action resulted in a discharge of the liability and remanded the case for determination of whether she was entitled to attorney fees based upon a violation of the Wisconsin Consumer Act. The trial court found a violation and awarded attorney fees on remand.
