I agree with Justin. At the very least you want to challenge the citation. The City Attorney's office will most likely offer to bargain the citation down to some lesser offense and fine. I offer free consultations for this kind of work.

Smoking in an apartment is not illegal unless the lease prohibits it. As for the "ticket," you do not say who issued it. If it is the CIty of Milwaukee it would be a municipal ordinance violation which is not a crime. Unless you started a fire, I would fight this.
