  • Someone is creating phony accounts thru twitter, linkedin, facebook using my name to sabotage my workers comp case, any advice?

    Bottom line, the worker’s comp. carrier is trying to get out of paying you compensation, or they are trying to lower the amount of money they owe you. Either way, you should probably talk to a worker’s comp. attorney.

    You can report it to your insurance company but they will probably want a police report. Does your parking lot have video surveillance? If so, get a copy before calling the police.
    Also, depending on how far you push this it may cost you your job. This is a consideration you also need to think about.

    Several questions need to be answered before we can help you. Who said the full amount of the damages was $4,029.00 and why have both insurance companies not paid this amount?

    Remember that when your car is damaged the insurance company is usually liable for the fair market value (FMV) of your car on the day of the crash, nothing more. Unfortunately with today’s prices, FMV is usually less than what it takes to buy a new car, resulting in additional costs for you.

    Have you consulted with a local attorney yet? If not, now would be a good time!

    My first question is whether or not your worker’s comp. claim has been denied? This could affect your ability/choice of light duty work.
    As long as your doctor has you off work you don’t have to go back to work. What your employer is doing is wrong and you should contact a worker’s comp. attorney ASAP to discuss your rights.
