  • Can my employer force me to go back to work while out on medical leave?

I developed severe carpal tunnel in both hands as a result of typing at work 8 hours a day, 5 days a week. My doctor didn't initially start a workman's comp. claim. So, I was scheduled for surgery but my boss asked me to postpone the surgery beca...

    David’s Answer

My first question is whether or not your worker’s comp. claim has been denied? This could affect your ability/choice of light duty work.
As long as your doctor has you off work you don’t have to go back to work. What your employer is doing is wrong and you should contact a worker’s comp. attorney ASAP to discuss your rights.

    Good luck.

  • A SIU is investigating my wifes ring claim that we lost it. can he legally obtain my phone records?

We lost my wifes ring but we found it 3 weeks later, but the insurance company still wants to investigate.

    David’s Answer

Did they pay you any money? If not, then I see no point in continuing with the claim. If they paid you money and the ring was actually lost, then your insurance company would probably have requested that you sign an authorization allowing them access to your phone records.

No claim, no access to phone records!

    Good luck.

    David’s Answer

While this could be considered medical malpractice, it appears that you have fully recovered and have minimal damages (medical bills and lost wages). Fortunately you were not seriously injured. Unfortunately, because of your low damages it may be hard to find an attorney willing to take on your case because the costs of prosecution are greater than the case value.

MY WIFE WAS IN AN AUTO ACCIDENT DRIVING HER CAR ON COMPANY TIME IS SHE ELIGIBLE FOR WORKMANS COMP IF SHE WAS INJURED?-

    David’s Answer

We need a little more information. Was she running an errand or driving as part of her job? If she was driving as part of her job then yes, she could claim worker's comp. Running an errand gets a little tricky.

Either way she needs to report this as a worker's comp. claim ASAP.

    Good luck.
