Appeal denial of a hardship waiver

Outcome:Approved on appeal.

Description:In October 2009, a client's hardship waiver was denied. The waiver was for misrepresentation. Usually I do not appeal hardship waivers because the AAO takes so long to make decisions, so it can be faster to re-file, but I did appeal this case because I was so certain the immigration officer erred. Because the client was here in the country, filing an appeal ensured she could remain in the country while the appeal was pending.
